Terms of Use

HootPODS LLC · Effective date: 6/10/2026

These Terms of Service (the “Terms”) govern your access to and use of the HootPODS platform and services (the “Service”) provided by HootPODS LLC (“HootPODS,” “we,” “our,” or “us”). By using the Service, you agree to these Terms.

1. Eligibility

  • You must be 18 or older, or the parent/guardian of a child user, to create an account.
  • By creating an account, you represent that you have legal authority to agree to these Terms.

2. Accounts & Security

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • Notify us immediately of any unauthorized use of your account.

3. Use of the Service

  • The Service is for personal, non-commercial use unless otherwise explicitly permitted.
  • You agree not to misuse the Service, including by attempting to access it using automated means or interfering with normal operation.
  • You will comply with all applicable laws and regulations.

4. Content

User Inputs

  • Parents/guardians may provide topics, text snippets, or URLs to generate educational podcasts for their child.
  • Do not submit sensitive personal data or content you do not have rights to use.
  • Submitted URLs/text are processed transiently and not stored after generating the podcast script.

HootPODS as a Tool

HootPODS LLC provides a creative tool that transforms user-submitted materials into personalized educational podcasts. Users are solely responsible for both the content they submit and the podcasts generated. HootPODS LLC does not act as the publisher of generated content; rather, the user determines the nature, purpose, and use of the Service outputs. Parents and guardians are expected to supervise and review all content before sharing it with children.

Generated Output

  • We store generated scripts and audio in your account history.
  • You may share or download podcasts for personal use; redistribution or commercial use may require additional permissions.

5. Payments & Credits

  • HootPODS uses a credit-based system. Purchases of subscription plans and credit packs are processed securely via Stripe.
  • Credits are a consumable usage metric with no cash value. Subscription and free-tier credits expire 60 days after the most recent credit grant to your account; credits purchased as a Credit Pack do not expire.
  • All sales are subject to our refund policy, if any, published in the Service.
  • We may change pricing or credit packages at any time with notice.

6. Intellectual Property

  • HootPODS trademarks, logos, and software are owned by HootPODS LLC or its licensors.
  • Except for your content, the Service content is protected by copyright and other laws.
  • You may not reverse engineer, decompile, or disassemble the Service except where permitted by law.

Intellectual Property – Patent Pending

Certain features, methods, and technologies incorporated in the HootPODS platform are the subject of one or more U.S. Provisional Patent Applications filed with the United States Patent and Trademark Office. As such, these features are Patent Pending. All rights in such patent applications are expressly reserved by HootPODS and/or its inventor(s). Users acknowledge that no license, ownership right, or interest in such patent applications is granted by virtue of their access to or use of the HootPODS platform.

7. Prohibited Conduct

  • Submitting unlawful, harmful, or infringing content.
  • Attempting to bypass security or rate limits.
  • Misrepresenting identity or affiliation.

8. Third-Party Services

The Service integrates with AWS, OpenAI (script generation and the optional Photo → Topic image-analysis feature), Stripe, and audio generation providers (e.g., ElevenLabs). Your use of those services is subject to their terms and policies.

9. Disclaimers & Limitation of Liability

  • The Service is provided “as is” without warranties of any kind.
  • We do not guarantee uninterrupted or error-free operation.
  • To the fullest extent permitted by law, HootPODS LLC will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

10. Indemnification

You agree to indemnify and hold harmless HootPODS LLC from any claims, damages, or losses arising from your breach of these Terms or your misuse of the Service.

11. Termination

We may suspend or terminate your access for any violation of these Terms or to protect the Service or its users.

12. Changes to These Terms

We may update these Terms from time to time. We will post updates with a revised Effective Date. Continued use of the Service means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to its conflict of law provisions.
